A Los Angeles judge has conditionally decided to dismiss a copyright infringement case against Taylor Swift. The suit had accused her of ripping off lyrics from 3LW’s “Playas Gon’ Play” for her hit “Shake It Off.” The Hollywood Reporter notes that the decision was reached after a judge decided that the lyrics “Playas, they gonna play / And haters, they gonna hate” aren’t eligible for protection under the Copyright Act. “[B]y 2001, American popular culture was heavily steeped in the concepts of players, haters, and player haters,” said U.S. District Judge Michael Fitzgerald. “The concept of actors acting in accordance with their essential nature is not at all creative; it is banal.” However, in the name of fairness, the judge is letting plaintiffs Sean Hall and Nathan Butler, the songwriters behind “Playas Gon’ Play,” take a stab at amending their complaint by Feb. 26.
